BQ34Z110 pulling P4/SCL low

Hello,

We have had a PCB made incorporating a BQ34Z110 with an implementation more or less as per Figure 8 (p32 of the datasheet) but without the SN74HC/LED's, without HDQ.   The chip supply is also taken from a 3.3V supply as opposed to the LDO regulator circuit with the zener & MOSFET.   VEN is not used, P1, P2, P5 are all unused.

We are having issues communicating between the Fuel Gauge and our processor, after around 2 bytes the SCL is being pulled low by the fuel gauge.   We feel this is perhaps something to do with the LED function?

As the IC is fresh off the reel, i would assume that the LED modes are set to 0 and I2C comms enabled by default.

Both SDA & SCL are held high by 10K resistors to +3.3V.  

Any advise would be appreciated,
